Although Tennessee has repealed estate taxes, the process can still be complex. In the event there is a will, the will must be presented, and the executor may then carry out their duties under the terms of the will. In the event an estate has less than $25,000 in assets, and the decedent did not own any real estate, a small estate affidavit may be filed within 45 days of death.

Mediation

In the event there is no will, the court will appoint an administrator of the estate. Like the executor, the administrator has an obligation to catalog, value, and distribute the assets of the estate. They must also file a final tax return for the estate.


Because the estate administrator, or executor, is charged with representing the interests of the heirs of the estate, they cannot legally represent themselves in court.
